Terms of Service

These Terms govern your use of LivingRGV, a local business directory, events surface, and creator marketplace for the Rio Grande Valley, Texas. By using the service or creating an account, you agree to them.

Accounts

You must provide an accurate email address. You are responsible for activity under your account. We authenticate by emailed sign-in link or Google sign-in; there is no password to protect, but the email inbox tied to your account effectively controls it.

Business Listings

Claiming a listing. A substantial portion of the directory was compiled from publicly available sources. If you own or are authorized to represent a listed business, you may claim its listing. By claiming, you represent that you are authorized to act for that business.

Your content. You retain ownership of the content you submit — descriptions, images, hours, links. You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the directory. This license ends when you remove the content, except for copies already distributed and for archival records.

Accuracy. You are responsible for the accuracy of the information you submit.

Directory Accuracy and Disclaimer

Directory information — including listings we compiled from public sources — is provided as is, without warranty of accuracy, completeness, or current availability. Hours change, businesses close, phone numbers get reassigned.

We do not endorse, vet, license-check, or guarantee any listed business. A listing is not a recommendation. Any transaction you enter into with a listed business is between you and that business. We are not a party to it and are not responsible for the goods or services provided, the outcome, or any dispute arising from it.

Inquiries and Lead Delivery

When you submit an inquiry to a business, your name, email address, phone number, and message are delivered to that business. That is the purpose of the form and it is disclosed to you at the point of submission. Once delivered, the business's handling of your information is its responsibility, not ours.

Before you send, the form shows you exactly what will be sent and to whom, and asks you to agree. By sending, you consent to that business contacting you by email about your message. We record that consent with a timestamp and store the exact wording you agreed to, so the record describes what was on screen rather than what a policy says was.

We do not collect a phone number on this form, so nothing here is consent to be called or texted.

Subscriptions and Billing

Paid tiers unlock additional placement and features for a claimed listing. Subscriptions are sold and billed through Stripe. Prices and what each tier includes are described at the point of purchase.

Payment card details are handled by Stripe and never reach our servers.

Cancellation and Refunds

Subscriptions are billed monthly in advance and may be cancelled at any time. Cancellation stops future billing and takes effect at the end of the current billing period; the listing retains paid features until that period ends, then reverts to the free tier.

Deleting your account is an exception to the paragraph above. Cancelling a subscription leaves paid features active until the end of the period you have already paid for. Deleting your account cancels any active subscription immediately and forfeits the remainder of that period. If you want to keep paid features through a period you have already paid for, cancel the subscription and leave the account open rather than deleting it.

Payments already made are non-refundable, including for partial billing periods and for periods during which the subscriber did not use the service. LivingRGV may issue a refund at its sole discretion; doing so in any instance does not create an obligation to do so in any other.

Cancellation requests are submitted through the account dashboard or to support@livingrgv.com.

Deleting Your Account

Deleting your account removes your profile and cancels any active subscription immediately, as described above. Some records do not belong solely to you and are not deleted with it:

  • Business listings you claimed revert to unclaimed and remain in the directory. They can be claimed again, by you or by someone else authorized to represent that business.
  • Events you submitted remain published. They are public information other people rely on, and are kept with your name removed.
  • Records of consent you gave are retained with your account link removed. A consent record that disappeared when an account closed would not be a record of anything.
  • Claim history is kept only as an anonymous record that a claim was made on a listing and decided on a date. Your name, email address, phone number, and IP address are erased from it.

Creator Marketplace

Creator profiles. Creators may publish a profile with a portfolio, a short description, a city, and an optional rate range. Profiles are reviewed before publication, and we may decline, edit, suspend, or remove one under Moderation and Removal below. A creator profile is a separate account type from a business listing — claiming a listing does not create one, and having one does not claim a listing.

Paid membership. A creator profile is a paid subscription, billed monthly, and is cancelled through the billing portal. Cancellation and refunds work the same way as for business listings, described under Cancellation and Refunds below. What you retain permission to display of a creator's work does not extend past their subscription — see their portfolio licence, linked below.

How a creator grants us permission to show their work. Two separate agreements, given when a creator signs up, and each recorded against the exact version they agreed to:

  • the Creator Portfolio Licence, which is required — it is the permission to display a creator's work on their profile and on the pages that lead people to it; and
  • Creator Promotional Use, which is optional — it adds promotional and editorial use, including the rotating hero on the creators page. A creator can decline it and still join.

Those documents govern their subject matter. This section does not restate or narrow them.

Contacting a creator. Businesses can message a creator through the site to discuss hiring them. We pass the message along and store it so both sides have a record of it.

Hiring is between you and the creator, and we are not part of it. This is the most important thing in this section, so it is stated plainly:

  • Any engagement, quote, scope, schedule, deliverable, revision, licence, or fee is agreed directly between the business and the creator. LivingRGV is not a party to it.
  • No payment for creative work passes through LivingRGV. We do not process, hold, escrow, split, invoice, or release payment between a business and a creator. The only money we handle is the subscription a business or creator pays us for its own membership.
  • We do not guarantee the work. We do not vet, supervise, insure, or warrant any creator's skill, availability, licensing, insurance, conduct, or the quality, timeliness, or suitability of anything they deliver.
  • We do not guarantee payment. We do not guarantee that a business will pay a creator, pay on time, or pay in full, and we have no obligation to collect, advance, refund, or make good any amount owed between them.
  • Creators are independent — not employees, agents, contractors, partners, or representatives of LivingRGV, and they cannot commit us to anything.
  • A dispute about the work or the money is between the business and the creator. We may, at our discretion, remove a profile or a listing under Moderation and Removal, but that is not a remedy for the dispute and does not resolve it.

Listing a creator is not a recommendation, endorsement, certification, or background check. Deciding who to hire, on what terms, is yours.

Events

Anyone may submit an event. Submissions are moderated before publication. We may decline or remove any submission.

Acceptable Use

Do not submit content that is unlawful, infringing, defamatory, deceptive, or that you lack the rights to submit. Do not claim a business you are not authorized to represent. Do not scrape, overload, or attempt to circumvent access controls.

Moderation and Removal

We may edit, decline, suspend, or remove any listing, event, image, profile, or account, at our discretion, with or without notice. We are not obligated to host anything.

The site links to third-party websites and booking tools. We do not control them and are not responsible for their content or practices.

Disclaimers and Limitation of Liability

The service is provided as is and as available, without warranties of any kind, to the fullest extent permitted by law.

Indemnification

You agree to indemnify LivingRGV against claims arising from content you submit, your use of the service, or your violation of these Terms.

Changes to These Terms

We publish a new version rather than editing a published one, and every prior version remains available at its own permanent URL. For material changes we notify registered users and, where the change affects the creator license specifically, require re-acceptance before continued use of the creator dashboard.
